Welcome to Whitis Contracting. These Terms and Conditions govern your use of our website and the services we provide. By engaging with us, you agree to the terms outlined below. We encourage you to read them carefully. If you have any questions, please contact us directly.
By accessing or using the Whitis Contracting website, you agree to be bound by these Terms and Conditions. If you do not agree with any part, you should discontinue use immediately. We reserve the right to update these terms at any time, and continued use constitutes acceptance of changes.
All estimates provided by Whitis Contracting are valid for 30 days unless otherwise stated. Services are performed by our in-house crews with fixed pricing agreements. Any changes to scope after signing will be documented in a written change order and agreed upon before proceeding.
Clients agree to provide reasonable site access, disclose known hazards such as underground utilities, grade changes, and easements, and secure necessary permits where applicable. Whitis Contracting will coordinate with local authorities, but final permit responsibility rests with the property owner.
Payment schedules are outlined in each contract. A deposit may be required for material procurement. Final payment is due upon substantial completion as defined in the agreement. Late payments may incur interest at 1.5% per month. All disputes must be submitted in writing.
Whitis Contracting shall not be held liable for indirect, incidental, or consequential damages arising from construction delays, material shortages, or unforeseen site conditions. Our liability is limited to the contract value. Force majeure events, including extreme weather, supply chain disruptions, or acts of God, may extend timelines without penalty.
These terms are governed by the laws of the Commonwealth of Kentucky. Any legal actions must be filed in Boyle County, Kentucky. If any provision is found unenforceable, the remaining terms remain in full effect. This constitutes the entire agreement between Whitis Contracting and the client.
